Over at Park Slope Parents someone posted that a group of picnickers got ticketed for drinking from an open wine bottle in Prospect Park. She says it happens to her friend. But I wonder. My advice to her friend: Transport your wine in something other than a wine bottle…
My friend got a ticket today in Prospect Park for being at a small 8-person picnic gathering
where there was one wine bottle out in the open. 4 cops came up and gave everyone a ticket
for alcohol possession. Does anyone know if this type of ticket is easy to fight? She wasn’t
drinking any wine nor does she drink in general.Also, as a side note she is trying to purchase a co-op apartment and is soon going to be
reviewed by the co-op approval board. Should she worry about this citation?Any insight would be appreciated.
Welcome to NYC kids! Cops have been ticketing in NYC Parks for open container for years. I got my first citation in Central Park for drinking a beer out of a brown paper bag in 1995. Looks like enforcement of this has finally spread to the outer boroughs. Some friends tried to fight it to no avail. Just send in the check and move along.
If the cops are going to bust people for beer in public (and rightfully so), why should wine drinkers get a pass? Is the more genteel drink excusable?
No worries about the co-op. This is the equivalent of a parking ticket and will not go on her rap sheet.
Jeez, pay the damned $25 fine already.

If true, outrageous. Meanwhile, cars are allowed to fly through the park at speeds greater than 50mph and they’re out ticketing people for drinking wine? How does that serve the public good?
The police in our hood are entirely abusive of their power and have no clue what it means to protect and serve the citizenry. If you point it out to them, you’ll see how quickly you are served. Very quickly.
